Terms

These Terms govern the use of the Free Tweet Deleter browser extension (the "Extension") and the website at tweetgone.com (the "Site"), each provided by Lazy K Software ("Lazy K Software", "we", "us") free of charge.

Agreement

  1. By installing the Extension, by using the Site, or by confirming a deletion, you agree to these Terms. If you do not agree to them, do not install or use the Extension.
  2. The Privacy Policy forms part of these Terms.

Eligibility

  1. The Extension is not for use by a person under 13 years of age.
  2. A person who has not reached the age of majority in their jurisdiction may use the Extension only where a parent or guardian has agreed to be bound by these Terms on their behalf and accepts responsibility for their use of it.
  3. By installing or using the Extension you represent that you meet the requirements of this section.

Licence

  1. Lazy K Software grants you a personal, non-exclusive, non-transferable and revocable licence to use the Extension for its intended purpose.
  2. You must not reverse engineer, redistribute, sell or sublicense the Extension, or use it to provide a service to any other person, except to the extent that this restriction cannot lawfully be imposed.

Your Responsibilities

  1. You warrant that the X account processed by the Extension is your own, or that you are authorised to delete its content.
  2. You are responsible for reviewing the deletion plan before confirming it, including both the items your criteria select and the items your rules retain.
  3. Your use of X remains subject to the terms and rules of X Corp. Lazy K Software is not responsible for any action taken by X in respect of your account.
  4. You must not use the Extension for an unlawful purpose, or in a manner that interferes with the services of X.

Operation Of The Extension

  1. The Extension deletes posts, replies, reposts and likes from the X account signed in to your browser, using that session, in the same manner as deleting them on X directly.
  2. The Extension paces its requests in order to remain within the limits imposed by X. Any time to completion shown by the Extension is an estimate and is not guaranteed.
  3. The Extension requires you to be signed in to X in the browser. It does not request and does not receive your credentials.

Deletion Is Irreversible

  1. Deletion performed through the Extension is permanent. X provides no facility for restoring deleted content, and Lazy K Software cannot recover it.
  2. A backup of the selected items is written to your device before each run. A backup is a record for reference only. It cannot be restored to your X account, whether by the Extension or by Lazy K Software.
  3. You are responsible for exporting and retaining any backup you wish to keep. Removing the Extension deletes any backup that has not been exported.

Actions Taken On Your Account

  1. Following the first run that deletes at least one item, and not following a dry run or a run that you stop, the Extension follows the account @tweet_gone from your account.
  2. Unless the setting "Help other users find this extension" is turned off before that run completes, the Extension also publishes one post concerning the Extension from your account.
  3. Neither action is repeated. Both may be reversed by you on X at any time.

Versions And Availability

  1. The Extension confirms with our service that the installed version remains supported. Where it does not, or where that confirmation cannot be completed, the Extension will not commence new work. Work already in progress is preserved.
  2. Lazy K Software may cease to support any version, and may modify, suspend or discontinue the Extension or the Site, at any time and without notice.
  3. X may alter its interfaces without notice, which may cause the Extension to fail or to behave differently.

Donations

  1. Donations are voluntary. They confer no licence, feature, priority or other entitlement.
  2. Donations are not refundable.

Disclaimer

  1. The Extension and the Site are provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory, including any warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement.
  2. Lazy K Software does not warrant that the Extension will be uninterrupted or free from error, or that it will delete any particular item or number of items.
  3. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law. Where liability for failure to comply with a consumer guarantee cannot be excluded, our liability is limited, at our election, to supplying the Extension again.

Limitation Of Liability

  1. To the maximum extent permitted by law, Lazy K Software and its contributors are not liable for any loss or damage arising out of or in connection with the Extension or the Site, or the inability to use either, including content deleted that you intended to keep, content that was not deleted, loss of data, and the restriction, suspension or loss of an X account.
  2. To the maximum extent permitted by law, Lazy K Software and its contributors are not liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profit, revenue, goodwill or opportunity, whether or not foreseeable and whether or not we were advised of the possibility of it.
  3. Where liability cannot be excluded, the total aggregate liability of Lazy K Software is limited to the amount paid by you to Lazy K Software for the Extension, which is nil.

Indemnity

  1. You indemnify Lazy K Software against any claim, loss, liability or expense arising from your breach of these Terms or your misuse of the Extension.

No Affiliation

  1. Free Tweet Deleter is independent software. It is not affiliated with, endorsed by, sponsored by or connected to X Corp.
  2. "X" and "Twitter" are trade marks of their respective owner and are used only to identify the service with which the Extension operates. "Tweet" is used descriptively.

Amendment

  1. Lazy K Software may amend these Terms. The date stated at the head of this document is the date of the current version, and continued use after an amendment takes effect constitutes acceptance.

Governing Law

  1. These Terms are governed by the laws in force in Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.

General

  1. If a provision of these Terms is held to be invalid or unenforceable, that provision is severed and the remaining provisions continue in force.
  2. A failure or delay in enforcing a provision is not a waiver of it.
  3. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Lazy K Software in respect of the Extension and the Site.
